Introduction to Startup India Initiative
Launched by the Government of India, the Startup India Initiative aims to create an environment that supports innovation, entrepreneurship and employment generation.
India has developed into one of the world's major startup ecosystems, with entrepreneurs building businesses across technology, manufacturing, services and other emerging sectors.
Starting a business is only the first step. Eligible businesses may also seek recognition under the Startup India framework through the Department for Promotion of Industry and Internal Trade (DPIIT).
At GKS & Associates, we assist entrepreneurs in understanding the recognition process, preparing the required information and navigating the applicable registration formalities.
Eligibility Criteria for DPIIT Recognition
Not every newly established business automatically qualifies for recognition as a startup. Eligibility depends on the applicable government criteria.
Entity Type
The business should be incorporated or registered in an eligible legal form such as a Private Limited Company, Registered Partnership Firm or Limited Liability Partnership, subject to the applicable rules.
Age of Entity
The entity must satisfy the prescribed age requirement from the date of incorporation or registration.
Annual Turnover
The entity must remain within the prescribed turnover threshold applicable under the Startup India recognition framework.
Original Entity
The business should not have been formed merely by splitting up or reconstructing an existing business, subject to the applicable rules.
Innovation & Scalability
The business should work towards developing, improving or innovating products, processes or services, or demonstrate scalability and potential for wealth and employment generation.
Key Benefits of Startup India Registration
Eligible startups may be able to access various benefits and support mechanisms under government initiatives, subject to the relevant conditions and approvals.
Tax Benefits
Eligible startups may apply for tax benefits under Section 80-IAC subject to the applicable eligibility conditions and approval process.
Angel Investment Support
Recognised startups may receive relief under applicable provisions relating to eligible investments, subject to prevailing tax rules.
Intellectual Property Support
Eligible startups can access government initiatives relating to intellectual property filing and facilitation.
Self-Certification
Certain eligible startups may benefit from self-certification mechanisms for specified labour and environmental compliances.
Public Procurement
Government initiatives may provide eligible startups with certain relaxations in public procurement requirements.
Startup India Registration Process
The registration and recognition process requires accurate information about the entity, its business model, innovation and scalability.
Business Incorporation
Ensure that the eligible business entity has been properly incorporated or registered and that the relevant incorporation and PAN documents are available.
Portal Registration
Create and maintain the required profile on the Startup India platform and provide the requested business information.
DPIIT Recognition Application
Complete the recognition application and provide a clear description of the business, innovation, problem being addressed and scalability potential.
Document Upload
Upload the relevant documents and supporting materials, such as a pitch deck, website information and intellectual property details, wherever applicable.
Verification & Recognition
The application is reviewed under the applicable Startup India/DPIIT process. Eligible applicants receive the applicable recognition certificate after approval.
Understanding the 80-IAC Tax Holiday
DPIIT recognition and eligibility for a tax benefit under Section 80-IAC are separate matters. Recognition does not automatically mean that the startup receives the tax deduction.
Section 80-IAC Tax Benefit
Eligible startups may apply for the applicable deduction under Section 80-IAC, subject to the conditions prescribed under the Income-tax Act and the relevant approval process.
- Eligibility: The entity must satisfy the conditions prescribed for the benefit.
- Innovation: The business may need to demonstrate the required innovation or value creation criteria.
- Financial Information: Detailed business and financial information may be required as part of the application.
- Professional Assistance: GKS & Associates can assist with documentation, project reports and financial projections.
Funding & Support Schemes
Depending on eligibility and prevailing government programmes, startups may explore funding, mentorship and credit-support initiatives.
Startup India Seed Fund Scheme
The scheme is designed to support eligible startups at stages such as proof of concept, prototype development, product trials and market entry through approved incubators.
MAARG
The MAARG platform provides a structured mentorship ecosystem connecting startups with mentors and industry professionals.
Credit Guarantee Support
Eligible startups may explore credit guarantee mechanisms designed to facilitate access to debt funding without traditional collateral requirements, subject to scheme conditions.
